Who we are: Minist is a suite of AI-powered tools for architectural visuals, operated by Minist Technologies, Inc.
(“Minist,” “we,” “us”). These Terms form a contract between Minist and the person or entity using our Services (“you”).
1) Using Minist
Eligibility. You must be at least 18 and able to form a contract. If you use Minist for a company, you represent you have authority to bind that company.
Account. Keep your credentials confidential. You’re responsible for all activity under your account.
Subscriptions & limits. Plans include monthly output allowances per user. We may throttle processing to protect the platform. Enterprise limits are set by agreement.
Payments. Fees are billed in advance per the plan you choose. Taxes/VAT may apply. Except where required by law or expressly stated, fees are non-refundable.
Changes. We may add, change, or discontinue features. If a change materially harms your paid use, you may cancel; prepaid periods are not refunded unless required by law.
2) Your Content & Outputs
Definitions.
“User Content” = files you upload (e.g., drawings, elevations, plans, photos), prompts, and any text you provide.
“Outputs” = files our tools generate for you (e.g., images or other rendered results).Ownership. You retain all rights to your User Content. Subject to applicable law and third-party rights, we assign to you any rights we may have in the Outputs we generate for you, excluding our underlying models, software, and IP.
License to operate the Service. You grant us a worldwide, royalty-free license to host, process, and transmit your User Content only to provide and improve the Service’s functionality, troubleshoot, and meet legal/security obligations.
Model improvement. We do not use your User Content to train any models by default. You may opt in (or out) to allow training on your content; if you opt in, we may retain copies for model improvement.
Feedback. If you provide feedback, we can use it without restriction.
3) Professional & Safety Notice
Not construction documents. Outputs are conceptual visuals. They are not stamped plans, specifications, structural analysis, MEP design, code review, or site verification.
Your duty of care. You’re responsible for field verification, code compliance, performance, life-safety, and securing any required professional review or permits.
Accuracy. AI can produce errors or artifacts. Always review and validate before relying on Outputs in any professional deliverable.
4) Acceptable Use
You agree not to:
Violate laws or third-party rights (including IP and privacy).
Upload confidential information you don’t have the right to use.
Attempt to extract source code, models, or underlying datasets.
Use the Service to create deceptive or harmful content (e.g., illegal surveillance, discrimination, malware, or content that incites violence).
Overload or interfere with the platform.
We may suspend or terminate accounts that breach these Terms or risk platform integrity.
5) Third-Party Services
Some features may rely on third-party infrastructure or integrations (e.g., cloud hosting, authentication). Their terms may apply; we’re not responsible for their services.
6) Confidentiality
We will protect your non-public information with reasonable administrative, technical, and physical safeguards. Enterprise confidentiality and security commitments may be set in a separate agreement or DPA.
7) Term & Termination
You may cancel at any time via your account settings. We may suspend or terminate for breach, abuse, non-payment, or legal risk. Upon termination, your right to use the Service ends; we may delete your data after a reasonable period unless law requires retention.
8) Disclaimers
THE SERVICE AND OUTPUTS ARE PROVIDED “AS IS.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES (EXPRESS OR IMPLIED), INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT ERROR-FREE OR UNINTERRUPTED OPERATION, NOR THAT OUTPUTS WILL MEET ANY CODE, STANDARD, OR PERFORMANCE CRITERIA.
9) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
(A) WE WILL NOT BE LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL; AND
(B) OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID TO MINIST IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.
10) Indemnity
You will defend and indemnify Minist against claims arising from your User Content, use of the Service in breach of these Terms, or violation of law or third-party rights.
11) Export, Sanctions & Regulatory
You must comply with all applicable export and sanctions laws. You may not use the Service if you are in or for the benefit of a prohibited jurisdiction or party.
12) Governing Law; Dispute Resolution
These Terms are governed by State of California, USA. Disputes will be resolved in the courts located in State and federal courts located in San Francisco, California, USA, unless otherwise required by law. You and Minist waive class actions to the fullest extent permitted.
13) Updates to Terms
We may update these Terms from time to time. We’ll post the effective date above. If changes are material, we’ll provide reasonable notice. Continued use after the effective date constitutes acceptance.

User Content. Files you upload (e.g., drawings, elevations, plans, photos, PDFs) and metadata necessary to process them.
Outputs. Files generated for you and delivery metadata.
Support. Communications you send to us.
Cookies & similar tech. To operate the site, remember preferences, analyze usage, and improve performance.
2) How We Use Data
Provide, maintain, and secure the Service.
Process files and deliver Outputs.
Prevent abuse, troubleshoot, and ensure reliability.
Communicate about the Service, including transactional messages.
Improve features and user experience (including anonymous analytics).
Comply with law and enforce our Terms.
3) Model Training & Content Controls
Default: We do not use your User Content to train any models.
Opt-in: You may choose to allow training on your content; you can change this at any time in settings (or by contacting us).
We may use aggregated, de-identified telemetry to understand performance and reliability.
4) Sharing
We share data with:
Service providers (e.g., hosting, storage, authentication, analytics, payments) bound by confidentiality and data-protection obligations.
Enterprise integrations you enable (e.g., SSO).
Legal/regulatory recipients when required by law or to protect rights and safety.
We do not sell your personal data.
5) International Transfers
If we transfer data across borders, we use lawful mechanisms (e.g., SCCs) and safeguards.
6) Security
We use reasonable administrative, technical, and physical safeguards appropriate for design files and imagery (e.g., encrypted transport and storage for content at rest where applicable, access controls, logging). No system is perfectly secure.
7) Retention & Deletion
User Content and Outputs are retained as needed to provide the Service and to meet legal obligations.
You can delete files from your account; backups may persist for a limited period.
On account closure, we delete or anonymize personal data within a reasonable timeframe unless retention is required by law or to resolve disputes.
8) Your Rights
Depending on your location, you may have rights to access, correct, delete, port, or restrict processing of your personal data, and to object to certain processing. You can exercise these rights via your account or by contacting us at privacy@minist.app.
9) Children
Minist is not directed to children under 13 (or the age required by your jurisdiction). We do not knowingly collect their personal data.
10) Legal Bases
We process personal data based on:
Contract (to provide the Service),
Legitimate interests (security, improvement, analytics),
Consent (where required, e.g., marketing, model training opt-in), and
Legal obligation.
11) Communications & Marketing
We send transactional messages related to your account. You can opt out of marketing emails via the unsubscribe link.
